Filing for an asylum application can be overwhelming for anyone, and it’s often a complex process that nobody should have to endure alone. Asylum Application in Raleigh, North Carolina

There are two different types of asylum applications: affirmative and defensive. If you are not in removal proceedings, you can apply through the USCIS. You will need to complete Form I-589 and pay a $100 filing fee within one year of arriving in the U.S. If you have been living here for over a year, our attorneys will work with you to determine your next steps. From there, you will be asked to submit biometric data (such as your fingerprints) at the Application Support Center (ASC) and attend an interview with an asylum officer. Our attorney can represent you during this interview, and if your asylum application is denied, we will continue to fight for your case in front of an immigration judge.

If you are going through removal proceedings, you’ll need to file Form I-589 defensively with the EOIR. Once your asylum application has been received, you will go to an initial hearing where an immigration judge will review your case and schedule an individual hearing for you. At the individual or merits hearing, our attorney can represent you and explain your testimony to the judge to support your asylum application. If the judge denies your claim, you can count on us to appeal the decision and continue fighting for your rights.
